1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the Happy Tails CBD website (the “Site”) and your purchase and use of products from Happy Tails CBD (“we,” “us,” “our,” “Happy Tails CBD”). By accessing or using the Site, placing an order, or otherwise interacting with us, you agree to these Terms. If you do not agree to these Terms, you should not use the Site or purchase products.

 

2. Eligibility

You must be at least 19 years old (or the legal age in your jurisdiction) to purchase from our Site. By placing an order, you represent and warrant that you are of legal age and capable of entering into binding contracts.

 

3. Orders, Acceptance & Cancellation

• When you place an order, you make an offer to buy the item(s). We may accept or decline the order at our discretion.
• Once we accept your order, a binding contract is formed.
• We reserve the right to refuse or cancel any order at any time — for example if we suspect fraud, inventory error, or non-compliance with local law.
• If we cancel an order after charging you, we will refund you promptly.

4. Product Information & Disclaimer

• We strive to present our products on the Site accurately. However, we do not guarantee that product descriptions, pricing, images, or other content is error-free, complete, or current.
• Because CBD pet products are not universally regulated or approved in many jurisdictions, our products are sold without any medical or veterinary claims. We do not claim that our products cure, treat, prevent, or mitigate disease.
• You agree that any use of our products is done at your own risk. Always consult your veterinarian before using CBD products with your pet.
• We disclaim all warranties to the maximum extent permitted by applicable law (including implied warranties of merchantability, fitness for a particular purpose, noninfringement).

 

5. Legal Compliance & Indemnification

• You agree to comply with all local, provincial/state, and federal laws relevant to your purchase, possession, use, and transportation of CBD pet products.
• Because laws differ by jurisdiction, you are responsible for ensuring that it is lawful for you to receive and use our products in your location.
• You agree to indemnify and hold us harmless from any claims, liabilities, damages, or costs (including legal fees) arising from your violation of these Terms or applicable laws.

 

6. Pricing & Payment

• All prices are in CAD, unless otherwise indicated, and exclude any applicable taxes (GST/HST) or shipping costs, which will be added at checkout.
• We reserve the right to change prices at any time before your order is accepted.
• We accept payment methods shown on the Site. You represent that you are authorized to use the payment method you choose.
• If a charge is refused by your bank, we may cancel your order.

 

 

7. Shipping, Title & Risk of Loss

• Title and risk of loss pass to you once we deliver the goods to the shipping carrier.
• We will ship to the address you specify. Ensure it is correct; we are not responsible for misdeliveries due to incorrect address information.
• Shipping timelines are estimates and not guaranteed. We are not liable for delays caused by the carrier, customs, weather, or other external factors.

 

 

8. Returns, Refunds & Exchanges

• Our Refund / Return Policy is part of these Terms.
• Unless expressly permitted in that policy, edible products (treats) are non-returnable due to hygiene and safety reasons.

 

 

9. Intellectual Property

• All trademarks, logos, content, images, text, and other proprietary materials on the Site are owned or licensed by us and are protected by copyright, trademark, and other laws.
• You may not reproduce, distribute, modify, or create derivative works of our content unless you have our express written permission.

 

 

10. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim arising out of or relating to these Terms, the Site, or our products, whether in contract, tort, strict liability or other theory, is limited to the amount you paid us for the products in the 12 months preceding the claim (or a small fixed amount, whichever is greater). In no event shall we be liable for any indirect, incidental, special, or consequential damages, including loss of profits, even if we have been advised of the possibility of such damages.

 

 

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of British Columbia, Canada without regard to conflict of law principles.
• Any dispute arising hereunder must be resolved in courts located in Abbotsford, BC. You consent to personal jurisdiction there.

 

 

12. Changes to Terms

We may revise these Terms at any time by posting an updated version on the Site. The “Effective Date” will be revised accordingly. Changes will not apply retroactively to orders already placed, unless required by law.

 

 

13. Severability & Waiver

• If a provision of these Terms is held invalid or unenforceable, that provision is struck and the remaining terms remain in full force.
• Our failure to enforce any right does not constitute a waiver unless expressed in writing.
